Under Texas community property laws, the court determines how marital property is split between the two spouses. Generally, community property, or property and income gained during a marriage is split 50-50.

There are a few exceptions, such as spousal abuse or hiding community assets, where a judge may alter the 50-50 rule.

Our law firm can help you work out an acceptable separation of marital assets. For instance, if you want to keep all of your retirement you could give your spouse your share of a house to make the split equitable. We take the approach that everything is negotiable.

We can also help with issues of debt division. Generally, we advise our clients to no longer share the payment of a single debt because of the problems that can cause in the future. If one spouse fails to pay a bill that remains a joint liability, the other is still on the hook. Whatever your situation, it is important to have a knowledgeable and dedicated lawyer to help you work through the issues of property division.
