The Divorce Process in Texas

In Texas, the legal process of getting a divorce generally proceeds as follows:

  • One of the spouses files an Original Petition for Divorce.
  • The other spouse must be served with notice of the petition, unless that spouse signs a waiver of service.
  • A hearing is scheduled for temporary orders for child support, custody, visitation and spousal support.
  • In most cases, the attorneys for the spouses then negotiate a settlement that resolves questions of property division, child custody, visitation and spousal support. The spouses may also choose mediation or collaborative law to achieve a divorce agreement.
  • If an agreement can be reached, the spouses and their attorneys then appear before a judge who issues a divorce decree and final orders concerning property division, child support, custody, visitation and spousal support.

In the event that the spouses cannot reach an agreement over key issues, the case then may proceed to trial. Evidence will be presented to a judge, who will make decisions based on his or her review of that evidence.

If yours is an uncontested divorce with no significant issues, it may be possible to complete the process in as little as 60 days. Typically however, a divorce takes 6 months to a year, or longer if the case goes to trial.
