The Private Divorce Process

In the collaborative law process, both parties agree to enter into good faith negotiations over issues involving children, property division and spousal support. In a series of discussions, the parties and their attorneys develop workable and fair solutions to these issues. If it is necessary, the spouses can consult with a financial advisor about tax issues or with other professionals. When the parties come to a mutually acceptable resolution of all issues, a divorce petition and a separate document will be brought before the court. The judge will sign the divorce decree and a separate document called an agreement incident to divorce that contains the details of the arrangements concerning property division, child custody, visitation and spousal support. The agreement incident to divorce is not filed in court. It remains entirely confidential.
